Peever Man Found Guilty of Abusive Sexual Contact

U.S. Attorney Brendan V. Johnson announced that Marcos Davila, age 54, of Peever, South Dakota, was found guilty by a federal jury in Aberdeen, South Dakota, this week of two counts of abusive sexual contact. The maximum penalty upon conviction is life imprisonment.

The charges relate to two incidents wherein Davila engaged in sexual contact with two juveniles, both under 14 years of age. The first incident occurred in the winter of 2002 and the second occurred in the summer of 2011. The investigation was conducted by the Sisseton-Wahpeton tribal police department, the BIA, and the FBI. The case was prosecuted by Assistant U.S. Attorney Thomas J. Wright.

A presentence investigation was ordered, and a sentencing date was set for October 15, 2012.
