Eagle Butte Man Arraigned on Firearms Charge

U.S. Attorney Brendan V. Johnson announced that an Eagle Butte man has been indicted by a federal grand jury for being a felon in possession of a firearm.

Kimo Little Bird, Sr., age 31, was indicted by a federal grand jury on December 11, 2012. He appeared before U.S. Magistrate Judge William D. Gerdes on December 17, 2012, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years’ imprisonment, a $250,000 fine, or both. The charge is merely an accusation, and Little Bird is presumed innocent until and unless proven guilty.

The investigation is being conducted by the U.S. Fish and Wildlife Service; Bureau of Alcohol, Tobacco, Firearms, and Explosives; Federal Bureau of Investigation; and the Bureau of Indian Affairs, Standing Rock Agency. Assistant U.S. Attorney Troy Morley is prosecuting the case. Little Bird was remanded to the custody of the U.S. Marshals Service. A trial date has not yet been set.
