  • District of South Dakota (605) 330-4400

United States Attorney Brendan V. Johnson announced that a Parmelee, South Dakota man has been indicted by a federal grand jury for aggravated sexual abuse of a child and first-degree burglary.

Trudell Smith, Jr., age 20, was indicted by a federal grand jury on July 19, 2011. Smith appeared before United States Magistrate Judge Mark A. Moreno on July 25, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is any term of years up to life, a $250,000 fine, or both. Restitution may also be imposed. The charges are merely accusations, and Smith is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Federal Bureau of Investigation and Rosebud Law Enforcement Services. Assistant United States Attorney Tim Maher is prosecuting the case. Smith was remanded to the custody of the U.S. Marshal pending trial. A trial has not yet been set.
