Oglala Man Sentenced for Sexual Abuse of a Minor

United States Attorney Brendan V. Johnson announced that an Oglala man charged with sexual abuse of a minor was sentenced on June 20, 2011, by U.S. District Judge Jeffrey L. Viken. Wilbur Toledo Flute, age 37, was sentenced to 18 months’ imprisonment, five years’ supervised release, and a $100 victim assessment.

Flute was indicted by a federal grand jury on January 19, 2011.

Between June and August 2008, Flute engaged in a sexual act with a 12-year-old. He pled guilty on April 1, 2011.

This case was investigated by the Federal Bureau of Investigation.

Assistant U.S. Attorney Eric Kelderman prosecuted the case.

Flute was immediately turned over to the custody of the U.S. Marshal.
