Second Fort Rice Man Sentenced for Bar Burglary

BISMARCK, ND—United States Attorney Timothy Q. Purdon announced that on April 7, 2011, Scott Nalley, 22, of Fort Rice, North Dakota, was sentenced by United States District Court Judge Patrick A. Conmy for a charge of burglary. Nalley pleaded guilty to the charge on December 1, 2010.

Judge Conmy sentenced Nalley to two years in federal prison, to be followed by three years of supervised release. Nalley was ordered to pay restitution of $6,803.32 and to pay a special assessment of $100 to the Crime Victim’s Fund.

On May 19, 2010, around 4:30 a.m., Nalley and co-defendant Jeremy Will entered the T Bar 3 near Cannonball, North Dakota, by prying open the entry door with crow bars. Nalley and Will stole liquor, a television, money and other items from inside the building.

The case was investigated by the Federal Bureau of Investigation and Bureau of Indian Affairs - Standing Rock Agency.

Will previously pleaded guilty and was sentenced on November 22, 2010, to three years and one month in federal prison, three years of supervised release, restitution of $6,803.32, and a special assessment of $100 paid to the Crime Victim’s Fund.

Assistant United States Attorney Rick Volk prosecuted the case.
