New Town Man Pleads Guilty to Assault with a Dangerous Weapon

BISMARCK—United States Attorney Timothy Q. Purdon announced that on February 23, 2011, Milo R. Red Tomahawk, 31, of New Town, North Dakota, pleaded guilty before United States District Court Judge Daniel L. Hovland to a charge of assault with a dangerous weapon.

In September 2010, Red Tomahawk got into an argument and physical altercation with the victim, who was living in the Parshall area. Red Tomahawk pushed that victim’s head into two walls in a home, causing the victim's head to go through the sheet rock. The victim’s injuries required medical attention but were not life-threatening.

The charge of assault with a dangerous weapon carries a statutory maximum penalty of 10 years in prison and a $250,000 fine.

The case was investigated by the Federal Bureau of Investigation, Bureau of Indian Affairs and Three Affiliated Tribes Police Department.

Sentencing for Red Tomahawk has been scheduled for May 23, 2011, in United States District Court in Minot, North Dakota, at 2:00 p.m.

Assistant United States Attorney Rick Volk is prosecuting the case.
