Porcupine, South Dakota Man Pleads Guilty to Second Degree Murder

RAPID CITY, SD—United States Attorney Brendan V. Johnson announced that Lucas New Holy, age 20, of Porcupine, appeared before U.S. District Judge Jeffrey L. Viken on February 18, 2011, and pled guilty to a charge of second degree murder. The penalty upon conviction is any term of years up to life imprisonment and/or a $250,000 fine.

On November 7, 2010, near Porcupine, New Holy struck another man repeatedly in the head with a baseball bat, killing him. The investigation was conducted by the FBI, BIA, and OST-DPS. The case is being prosecuted by Assistant U.S. Attorney Robert A. Mandel.

A presentence investigation was ordered, and a sentencing date was set for May 20, 2011. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
