Eagle Butte Man Pleads Guilty to Misprision of a Felony

United States Attorney Brendan V. Johnson announced that Oscar Whiteman, age 23, of Eagle Butte, appeared before United States District Judge Roberto A. Lange on June 21, 2011, and pled guilty to a superseding information that charged him with misprision of a felony. The maximum penalty upon conviction is three years in custody, a $250,000 fine, or both; one year of supervised release; and a $100 special assessment.
The charge relates to Whiteman’s failure to report the crime of assault with a dangerous weapon when Ronald Parker shot a man at the South Main Apartment Complex in Eagle Butte, South Dakota, on March 19, 2011. Specifically, Oscar Whiteman pled guilty to having knowledge of the actual commission of a felony cognizable by a court of the United States, that is, an assault with a dangerous weapon, regarding the unlawful assault by Ronald Richard Parker, Jr., with a revolver, and concealed the same from tribal and federal law enforcement officers.
The investigation was conducted by the Federal Bureau of Investigation and the Cheyenne River Sioux Tribe Law Enforcement Division. The case is being prosecuted by Assistant United States Attorney Mikal Hanson.
A presentence investigation was ordered, and a sentencing date was set for September 6, 2011. The defendant was remanded to the custody of the United States Marshal pending sentencing.
