Rapid City Man Indicted on Marijuana and Cocaine Charges

United States Attorney Brendan V. Johnson announced that a Rapid City man has been indicted by a federal grand jury for possessing while intending to distribute and distributing marijuana and cocaine near Pine Ridge. Ricky Bagola, age 24, was indicted by a federal grand jury on November 17, 2010, for distribution of a controlled substance and possession with intent to distribute a controlled substance. He appeared before U.S. Magistrate Judge Veronica L. Duffy on November 24, 2010, and pled not guilty to the indictment. The maximum penalty upon conviction of the marijuana charges is five years of imprisonment and/or a $250,000 fine; the maximum penalty upon conviction of the cocaine charges is 10 years of imprisonment and/or a $250,000 fine. The charges are merely accusations, and Bagola is presumed innocent until and unless proven guilty. The investigation is being conducted by the FBI and ATF. Assistant U.S. Attorney Mark A. Vargo is prosecuting the case. Bagola was remanded to the custody of the U.S. Marshal. A trial date has not yet been set.
