Minneapolis Man Pleads Guilty to Robbing TCF Bank

A 42-year-old Minneapolis man pleaded guilty today in federal court to robbing the TCF Bank located at 1444 Lake St. on Nov. 12, 2008.

Herbert Ray Kelly pleaded guilty to one count of bank robbery. He entered his plea on April 21 in Minneapolis before United States District Court Judge Ann Montgomery. Kelly was indicted on Dec. 16.

According to Kelly’s plea agreement, he admitted that on Nov. 12, he did, by force, violence and intimidation, take approximately $3,760 from the bank.

According to a FBI affidavit, on Nov. 12, at approximately 10:30 a.m., the TCF Bank was robbed. The robber approached a teller and handed the teller a note, which stated, “I have a gun. I want all the $100, $50 and $20. Don’t call the police or I will come back for you.” The teller complied and gave the cash to the robber, who left the bank on foot.

A witness told police that she saw the robber running westbound on Lake Street from the front entrance of the bank, and a short time later, she saw the robber riding a Metro Transit bus going eastbound on Lake Street.

Officers stopped the bus along Hennepin Avenue, found Kelly, who appeared to match the robber’s description and arrested him. During a search of Kelly’s bag, officers discovered $3,740
in cash. The remaining $20 had been used to pay for bus fare.

Kelly faces a potential maximum penalty of 20 years in prison. Judge Montgomery will determine Kelly’s sentence at a future date. This case is the result of an investigation by the FBI
and the Minneapolis Police Department. It is being prosecuted by Assistant U.S. Attorney Erika R. Mozangue.
