Oglala Man Re-Sentenced for Cocaine Conspiracy

United States Attorney Marty J. Jackley announced that a man charged with conspiracy to distribute cocaine and possession with intent to distribute cocaine was re-sentenced on May 18, 2009, by US District Court Chief Judge Karen E. Schreier, pursuant to a remand by the Eighth Circuit Court of Appeals. Flint Thomas Red Feather, age 37, of Oglala, was re-sentenced to 151 months’ imprisonment, five years’ supervised release, and a special assessment of $100 to the Victim's Assistance Fund (count I); and 151 months’ imprisonment, three years’ supervised release, and special assessment of $100 to the Victim's Assistance Fund (count III)—both prison terms to run concurrent. Red Feather was indicted by a superseding indictment in February 2006 regarding charges which involved the illegal sale of drugs on the Pine Ridge Indian Reservation. On October 4, 2006, Red Feather was found guilty by a jury of conspiracy to distribute cocaine and possession with intent to distribute cocaine. The sentence was remanded to the district court on February 18, 2009, by the Eighth Circuit Court of Appeals for the court to make specific findings. This case was investigated by the FBI, ATF, SD UNET, Rapid City Police Department, and Oglala Sioux Tribal Police. The case was prosecuted by Assistant US Attorney Mara M. Kohn. Red Feather was immediately turned over to the custody of the US Marshal.
