West Allis Man Charged with Making Threats Against Mayfair Mall

James L. Santelle, United States Attorney for the Eastern District of Wisconsin, announced today that a criminal complaint was issued against Michael L. Musgrove (age 40), of West Allis, for transmitting a threat to injure in interstate commerce. According to the criminal complaint, the threat to injure was made in a posting on Craigslist on January 14, 2011, and refers to bringing a firearm to Mayfair Mall.

If convicted of the offense, Musgrove faces a penalty of up to five years’ imprisonment, a maximum fine of $250,000 fine, and a $100 special assessment, plus a period of supervised release.

This case was investigated by the Wauwatosa Police Department and the Federal Bureau of Investigation and has been assigned to Assistant United States Attorney Erica N. O’Neil for prosecution.

According to United States Attorney Santelle, “Today’s complaint reflects the continuing commitment of the Justice Department to investigate promptly and prosecute immediately any person who threatens or seeks to threaten the security and well-being of our community. Our prosecution of this and like cases is premised on the fundamental notion that all citizens should feel safe and be safe in public places and in neighborhoods throughout our nation.”

A criminal complaint is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.
