Federal Grand Jury Returns Indictments

MADISON, WI—A federal grand jury in the Western District of Wisconsin, sitting in Madison, returned the following indictments today. You are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.

TOMAH MAN CHARGED WITH BANK FRAUD

Dennis J. Deeny, 59, Tomah, Wisconsin is charged with nine counts of bank fraud. According to the indictment, Deeny was one of two shareholders in Affordable Homes, a business located in Tomah engaged in the sale of modular homes, and was responsible for its day to day operation. The indictment alleges that from March 2006 to March 2007, Deeny defrauded Farmers and Merchants Bank, Tomah, by selling modular homes which were financed by the bank and failing to pay to the bank approximately $227,540 in proceeds from the sales.

If convicted, Deeny faces a maximum penalty of 30 years in federal prison on each count. The charges against him are the result of an investigation by the La Crosse office of the Federal Bureau of Investigation. The prosecution of this case has been assigned to Assistant U.S. Attorney Grant C. Johnson.

SECOND MAN CHARGED WITH STEALING FIREARMS FROM MADISON GUN SHOP

Darren Richardson, 20, Chicago, and Daniel Barlow, 22, Madison, Wisconsin are charged in a superseding indictment with stealing firearms and transporting a stolen firearm in interstate commerce. Barlow is also charged with being a felon in possession of firearms. Barlow was originally charged with these crimes in an indictment returned by the grand jury on June 9, 2010. Barlow was arraigned on June 15. His trial is scheduled for September 20 before U.S. District Judge Barbara B. Crabb.

The indictment alleges that Richardson and Barlow stole 20 firearms from Grampa’s Gun Shop on Williamson Street, Madison, on March 13, 2010. The indictment alleges that they stole 16 handguns, a shotgun, and three rifles. Barlow is charged with transporting one of the stolen handguns from Wisconsin to Minnesota between March 13 and April 4, 2010, and Richardson is charged with transporting three of the stolen handguns from Wisconsin to Illinois between March 13 and May 21, 2010.

If convicted, Richardson and Barlow face a maximum penalty of 10 years in federal prison on each count. The charges against them are the result of an investigation by the Madison Police Department and Bureau of Alcohol, Tobacco, Firearms and Explosives. The prosecution of this case has been assigned to Assistant U.S. Attorney Rita M. Rumbelow.

EAU CLAIRE MAN CHARGED WITH MANUFACTURING METHAMPHETAMINE

Terrance D. Newcomb, 40, Eau Claire, Wisconsin is charged with manufacturing methamphetamine and possessing equipment, chemicals and material which may be used to manufacture methamphetamine. The indictment alleges that he manufactured the drug on April 3, 2010, and possessed the equipment and chemicals on April 5, 2010.

If convicted, Newcomb faces a maximum penalty of 20 years in federal prison on each count. The charges against him are the result of an investigation by the West Central Drug Task Force. The prosecution of this case has been assigned to Assistant U.S. Attorney Elizabeth Altman.

MADISON MAN CHARGED WITH POSSESSION OF CRACK COCAINE

Jermaine M. Shelly, 33, Madison, Wisconsin is charged with possessing 50 grams or more of crack cocaine with intent to distribute. The indictment alleges that he possessed crack cocaine on June 30, 2010.

If convicted, Shelly faces a mandatory minimum penalty of 10 years and a maximum penalty of life in federal prison. The charge against him is the result of an investigation by the Dane County Narcotics and Gang Task Force. The prosecution of this case has been assigned to Assistant U.S. Attorney Elizabeth Altman.

BELOIT MAN CHARGED WITH GUN CRIME

Jacob R. Risseeuw, 24, Beloit, Wisconsin is charged with being a felon in possession of a firearm and ammunition. The indictment alleges that he possessed a 9mm pistol and ammunition on March 18, 2010.

If convicted, Risseeuw faces a maximum penalty of 10 years in federal prison. The charge against him is the result of an investigation by the Beloit Police Department and Bureau of Alcohol, Tobacco, Firearms and Explosives. The prosecution of this case has been assigned to Assistant U.S. Attorney Laura Przybylinski Finn.

TWO MEN CHARGED WITH ILLEGAL RE-ENTRY INTO UNITED STATES

In unrelated cases, two citizens of Mexico are charged with illegally re-entering the United States after previously being deported. The indictments charge Reyes Venegas-Cruz, 25, found in Dane County on June 18, 2010, and Jose Luis Munoz, 25, found in Rock County on May 31, 2010.

If convicted, Venegas-Cruz and Munoz face a maximum penalty of 20 years in federal prison. The charges against them are the result of investigations by U.S. Immigration and Customs Enforcement. The prosecution of Venegas-Cruz has been assigned to Assistant U.S. Attorney Timothy M. O’Shea and Munoz has been assigned to Assistant U.S. Attorney Meredith P. Duchemin.
