Former Grant Writer for the City of Davie is Sentenced

Wifredo A. Ferrer, United States Attorney for the Southern District of Florida; Jose A. Gonzalez, Special Agent in Charge, Internal Revenue Service, Criminal Investigation Division (IRS-CID); and John V. Gillies, Special Agent in Charge, Federal Bureau of Investigation (FBI), Miami Field Office, announce the sentencing of defendant Richard Rubin, 65, of Southwest Ranches. Rubin was sentenced today, before U.S. District Court Judge William J. Zloch, to 10 months’ imprisonment, followed by three years of supervised release. Rubin was also ordered to pay restitution in the amount of $104,671.08. Rubin pled guilty to tax evasion, in violation of Title 26, United States Code, Section 7201 on April 20, 2011.

According to documents filed with the court, Rubin willfully filed a federal income tax return that failed to report real estate commissions that he had received from the sale of a property described at the “Sunny Lakes” property and the sale of a condominium in Hollywood, Florida. At the closing on the Sunny Lakes property, defendant Rubin’s sales commission of $102,000 was paid to another real estate broker who, in January 2005, funneled the entire commission of $102,000 to defendant Rubin. Defendant Rubin also received a commission in the amount of $6,297 as the real estate agent for the sale of a condominium in Hollywood. Defendant Rubin’s sales commission on this condominium was paid to another real estate broker who, in January 2005, funneled the entire commission of $6,297 to defendant Rubin.

Mr. Ferrer commended the investigative efforts of the IRS’s Criminal Investigation Division and the FBI. This case is being prosecuted by Assistant U.S. Attorney Jeffrey N. Kaplan.
