Hogsett Announces More Results in Recent Violent Crime Initiative
Indianapolis Man Indicted for Possession of a Firearm by a Convicted Felon

INDIANAPOLIS—Joseph H. Hogsett, United States Attorney, announced today even more results from the United States Attorney’s Office’s 2011 Violent Crime Initiative to target violent, repeat offenders. Specifically, Lovoyne Drain a/k/a Lavyne Lacy, 31, of Indianapolis, was charged today with three counts of unlawful possession of firearms or ammunition by a convicted felon following an investigation by the Federal Bureau of Investigation Safe Streets Task Force, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and the Indianapolis Metropolitan Police Department.

According to the indictment and the criminal complaint filed earlier, in December of 2009, Drain allegedly possessed a rifle that had been stolen from the FBI. In June 2010, Drain allegedly possessed a pistol and ammunition at his Indianapolis residence. These items were found upon execution of a search warrant at Drain’s home.

According to Assistant United States Attorney James M. Warden, who is prosecuting this case for the government, Drain has four prior felony convictions: three concerning unlawful possession of cocaine and one regarding unlawful possession of a handgun. Drain faces a maximum of 10 years in prison and a $250,000 fine on each count. An initial hearing will be scheduled in Indianapolis before a U.S. Magistrate Judge.

An indictment is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.
