Federal Grand Jury in Fort Wayne Returns Indictments

FORT WAYNE, IN—The United States Attorney’s Office announced that a Grand Jury sitting in Fort Wayne, Indiana, returned the following indictments on September 1, 2010:

Beatriz Bojorquez, 32, of the 10000 block of Old Woods Road, Fort Wayne, Indiana; Benjamin VanAllen, 31, of the 7600 block of Woodbine Avenue, Fort Wayne, Indiana; and Adrian Juarez, 35, of the 1600 block of East Hollis Lane, Fort Wayne, Indiana, were charged by an indictment with conspiring to distribute and to possess with intent to distribute 50 grams or more of methamphetamine. Furthermore, the grand jury indicted Beatriz Bojorquez and Benjamin VanAllen with maintaining a drug-involved premises.

James B. Morris II, 32, of the 400 block of East Main Street, Butler, Indiana, was charged by indictment with four counts of distributing methamphetamine.

Gary Bitzell, 41, of the 6700 block of Goldenrod Place, Fort Wayne, Indiana, was charged by indictment with five counts of using a telephone to facilitate methamphetamine distribution.

In addition, Jorge Rosas-Ramirez, 36, of the 10000 block of Old Woods Road, Fort Wayne, Indiana, was charged by criminal complaint with five counts of distributing methamphetamine.

The Federal Bureau of Investigation and the Safe Streets Task Force Gang Narcotics Enforcement Team (G-NET) today served search warrants at eight residences and arrested these individuals after completing an investigation into a methamphetamine trafficking conspiracy in Fort Wayne, Indiana, which involved the importation and distribution of “ice” or “crystal” methamphetamine. The year-long investigation utilized many sophisticated investigative techniques and involved the cooperation and assistance of law enforcement officers from many different agencies.

G-NET is comprised of special agents and detectives from the Federal Bureau of Investigation, the Indiana State Police, the Allen County Police Department, and the Fort Wayne Police Department, and its investigators work together in a task force environment to investigate the illegal activities of gangs and drug trafficking organizations in the Fort Wayne Division of the Northern District of Indiana.

Also assisting in this investigation were the United States Marshals Service, the Indiana State Police Drug Enforcement Section, the Allen County Drug Task Force, the Fort Wayne Police Department’s Vice and Narcotics Division, and the Indiana Multi-Agency Group Enforcement (IMAGE) Drug Task Force.

These case are being prosecuted by Assistant United States Attorneys Tina Nommay and Anthony Geller.

The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.

The United States Attorney’s Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.
