Second Colorado Springs Man Sentenced to Federal Prison for Being a Felon in Possession of a Firearm

DENVER—A Colorado Springs man has been sentenced to federal prison for being a felon in possession of a firearm, United States Attorney David Gaouette and Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Special Agent in Charge Richard Chase announced. Clint Ayotimia Jacobs, age 29, of Colorado Springs, Colorado, was sentenced last week to serve 51 months (just over four years) in federal prison, followed by three years of supervised release, for the criminal felon in possession of a firearm charge. The sentence was pronounced by U.S. District Court Judge Philip A. Brimmer. Jacobs appeared at the sentencing hearing in custody, and was remanded immediately afterwards.

Clint Ayotimia Jacobs was indicted by a federal grand jury in Denver on February 24, 2009. He pled guilty before Judge Brimmer on June 25, 2009. He was sentenced on October 2, 2009.

According to the stipulated facts contained in the plea agreement, on January 15, 2009, officers from the Colorado Springs Police Department were looking for Jacobs because he had outstanding warrants for his arrest. The officers had learned that the defendant had told others that he was not going back to jail and that he would kill police officers to prevent that from happening.

That evening officers confirmed that Jacobs was the passenger in a motor vehicle and began to follow it. The vehicle pulled into a convenience store and the driver exited the vehicle. At that time an officer approached the vehicle and gave the defendant the command to show his hands. The defendant repeatedly refused to comply with this command, so officers physically removed him from the vehicle. As they were doing so, Jacobs stated several times, “it’s on my left hip, it’s on my left hip.” Officers then recovered from the defendant’s left hip a Ruger .357 caliber revolver. The defendant was then arrested based on outstanding warrants. Jacobs also was responsible for shoot his firearm the night before at a man because the man had grabbed his girlfriend.

Jacobs possessed the firearm while being a convicted felon, which is prohibited under federal law. He had the following convictions:

  • Possession of a Controlled Substance – Schedule 2 on or about November 21, 2005, in El Paso County.
  • Burglary of an Automobile on or about May 17, 1999, in Tulsa County, Oklahoma.
  • Knowingly concealing stolen property on or about May 17, 1999, in Tulsa County, Oklahoma.
  • Unlawful possession of a controlled substance on or about June 14, 2004, in Tulsa County, Oklahoma.
  • Unlawful possession of paraphernalia on or about June 14, 2004, in Tulsa, Oklahoma.

“This case exemplifies that the combined resources, expertise, and efforts of federal and local law enforcement will be utilized to track down convicted felons who are fugitives from justice,” said ATF Special Agent in Charge Richard Chase.

The Jacobs case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Brown was prosecuted by Assistant U.S. Attorney Kurt Bohn.
