Summerville Men Face Federal Charges for Transporting Stolen Construction Equipment

COLUMBIA, SC—Acting United States Attorney Kevin F. McDonald stated today that Austin Davis, age 26, and Allen Miller, age 26, both of Summerville, were charged in a four-count federal indictment with interstate transportation of stolen property, a violation of Title 18, United States Code, Section 2314.

The indictment alleges that between January and May 2009, Davis and Miller unlawfully transported construction equipment reported stolen from work sites in South Carolina to Ohio, Kentucky, Virginia, and North Carolina, knowing that the equipment had been stolen.

The maximum penalty that Davis and Miller could each receive is a fine of $250,000 and imprisonment for 10 years.

Arraignments for both men will be scheduled alter this month.

Mr. McDonald stated that the case was investigated by agents of the FBI and that he has assigned the case to Assistant United States Attorney Rhett DeHart of the Charleston office for prosecution.

The United States Attorney stated that all charges in this Indictment are merely accusations and that all defendants are presumed innocent until and unless proven guilty.
