Attorney Sentenced in Cuyahoga County Corruption Probe

William J. Edwards, First Assistant United States Attorney for the Northern District of Ohio; C. Frank Figliuzzi, Special Agent in Charge of the Cleveland Division of the FBI; and Jose A. Gonzalez, Special Agent in Charge of the Internal Revenue Service, Criminal Investigation Division, today announced the first sentencing of a defendant in the Cuyahoga County Corruption Probe. Judge Kathleen M. O’Malley sentenced attorney Bruce Zaccagnini, age 49, of North Royalton, Ohio, to 60 months of imprisonment and two years of supervised release for his role in a kickback scheme that caused a loss of approximately $11.5 million to the County. Judge O’Malley also ordered Zaccagnini to pay $3,215,845 (his share of the proceeds of the scheme) in restitution to Cuyahoga County. Zaccagnini has already paid $500,000 toward this restitution obligation.

Zaccagnini previously pleaded guilty to conspiring with attorneys Louis C. Damiani (deceased), Timothy Armstrong and an unnamed lawyer to pay PO2 approximately $1.2 million in cash kickbacks on approximately $22 million in County commercial reappraisal contracts over a period of ten years. Former Auditor’s Office employee Santina Klimkowski has pleaded guilty to serving as an intermediary for the kickback payments and has admitted accepting approximately $154,000 in cash kickbacks herself. Klimkowski has paid $91,859.48 toward restitution. The Court has not scheduled a sentencing date for Klimkowski. Armstrong has pleaded guilty for his role in the conspiracy and his sentencing is scheduled for February 3, 2010. Armstrong has already paid $1,573,345 in restitution. In addition, the United States Attorney’s Office has filed a forfeiture action against $1.95 million which Louis Damiani obtained as a result of the conspiracy.
