Defendant in Killing of UNC Student Body President Sentenced
Atwater to Serve Life Plus 10 Years in Federal Prison

GREENSBORO, NC—John W. Stone, Jr., Acting United States Attorney for the Middle District of North Carolina, announced that DEMARIO JAMES ATWATER was sentenced today in connection with the March 5, 2008 murder of UNC-Chapel Hill Student Body President Eve Marie Carson.

The sentence was handed down in Winston-Salem today by United States District Court Judge James A. Beaty, Jr. ATWATER was sentenced to life in prison plus five years’ supervised release on each of Counts One and Two (carjacking resulting in death; kidnapping resulting in death); 120 months’ imprisonment plus five years’ supervised release on Count Three (carrying and discharging a shortbarreled shotgun); and 120 months imprisonment plus three years’ supervised release on each of Counts Four and Five (possession of firearms by a convicted felon; possession of a short-barreled shotgun). The sentence on Count Three is to run consecutively to the sentences on Counts One, Two, Four and Five. In addition, Judge Beaty announced that the sentence imposed on the federal charges would not run concurrently with any previously-imposed state sentence. ATWATER was also ordered to pay $212,947.10 in restitution and $500.00 in special assessment.

The case was investigated by the Federal Bureau of Investigation, the United States Bureau of Alcohol, Tobacco, Firearms and Explosives, the North Carolina State Bureau of Investigation, the Chapel Hill Police Department, and the Durham Police Department.
