Defendants in Operation Dare Devil Receive Federal Sentences

RALEIGH—United States Attorney George E.B. Holding announced that in federal court on June 8, 2010, United States District Judge James C. Dever, III, sentenced two defendants for drug distribution. WILBUR CHARITY, 30, received 300 months’ imprisonment followed by five years supervised release. CARRIE ANN MOSHER, 29, received 60 months’ imprisonment followed by five years’ supervised release. Both defendants are from Kill Devil Hills, North Carolina.

A federal grand jury returned a Criminal Indictment on November 4, 2009, charging CHARITY. On June 23, 2009, MOSHER was charged by Criminal Information. Both defendants pled guilty on January 13, 2010; CHARITY to conspiring to possess with the intent to distribute five kilograms or more of cocaine and 50 grams or more of cocaine base (crack) and MOSHER to conspiring to possess with the intent to distribute 500 grams or more of cocaine, 50 grams or more of cocaine base (crack) and a quantity of marijuana.

On January 2, 2009, a Currituck County Sheriff’s Deputy stopped a car, being driven by MOSHER and in which CHARITY was a passenger, for a traffic violation. Due to information received by law enforcement, a K-9 search was performed on the interior of the car. The deputy found 495 grams of cocaine on the passenger side floorboard. The investigation showed that CHARITY was responsible for distributing more than 300 ounces of cocaine and five ounces of crack cocaine and MOSHER was responsible for distributing more than 3,600 grams of cocaine and 400 grams of cocaine base. The cocaine was imported through Virginia and distributed into Dare and Currituck Counties.

This case was brought as a part of an Organized Crime Drug Enforcement Task Force (OCDETF) Operation entitled Dare Devil, investigating importers and multi-level distributors of cocaine and cocaine base (crack) into Dare and Currituck County.

Investigation of this case is being conducted by the Federal Bureau of Investigation, the Currituck County Sheriff’s Office, the Dare County Sheriff’s Office, and the Kill Devil Hill Police Department. Special Assistant United States Attorney Timothy Severo represents the government. Mr. Severo is a prosecutor with the New Hanover District Attorney’s Office. District Attorney Ben David has assigned him to the United States Attorney’s Office to prosecute federal Organized Crime Drug Enforcement Task Force criminal matters. This has been made possible by a grant funded by the Governor’s Crime Commission and the New Hanover County Commissioners.
