Convicted Felon/Gang Member Receives Federal Prison Time

RALEIGH—United States Attorney George E.B. Holding announced that in federal court on January 28, 2010, United States District Judge James C. Dever, III, sentenced HAKIM RASHEED HANIFAH, 22, of Wilmington, North Carolina, to 96 months' imprisonment to be followed by 36 months of supervised release. In August 2009, HANIFAH pled guilty to unlawful possession of a firearm by a felon. On January 1, 2008, the Wilmington Police Department began investigating multiple shooting incidents involving several gang members in and around Wilmington, North Carolina. As a result of the investigation, on January 10, 2008, law enforcement obtained a search warrant for HANIFAH’S residence. The officers found a loaded Marlin 30-30 rifle, additional ammunition, and gang paraphernalia in HANIFAH’S bedroom. According to the Federal Bureau of Investigation’s Safe Street Task Force, HANIFAH is a validated member of a violent street gang. While in custody and awaiting sentencing in this case, HANIFAH punched a correctional official in the face because he was not satisfied with the amount of food that he was served on Christmas Eve. The jailor sustained lacerations to the area under his right eye and the bridge of his nose which required medial attention.

The investigation of this case was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives; the Federal Bureau of Investigation Safe Streets Task Force; and the Wilmington Police Department.

Assistant United States Attorney Gaston Williams and Special Assistant United States Attorney Timothy Severo represented the government. Mr. Severo is a prosecutor with the New Hanover District Attorney’s Office. District Attorney Ben David has assigned him to the United States Attorney’s Office to prosecute federal Organized Crime Drug Enforcement Task Force criminal matters. This has been made possible by a grant funded by the Governor’s Crime Commission and the New Hanover County Commissioners.
