Man Pleads Guilty to Conspiracy to Distribute Crack Cocaine

BUFFALO, NY—U.S. Attorney William J. Hochul, Jr. announced today that Jimmy Reuther, 26, of Buffalo, New York, pled guilty before U.S. District Judge Richard J. Arcara to conspiracy to distribute 50 grams or more of cocaine base. The charge carries a mandatory minimum sentence of 10 years in prison and a maximum penalty of life, a fine of $4,000,000 or both.

Assistant U.S. Attorney Joseph M. Tripi, who is handling the case, stated that beginning in 2004 and continuing until July 2010, Reuther, along with members and associates of the 10th Street Gang, conspired to distribute 50 grams or more of cocaine base. The investigation consisted of physical surveillance, video surveillance, controlled evidence purchases, and information provided by confidential informants. 10th Street Gang members and associates sold quantities of cocaine base to both drug users and other drug distributors inside and outside of 224 Virginia Street, Buffalo, New York, a corner store known as Musa's Party Express. The distribution of crack cocaine occurred almost daily at that location. Reuther assisted the drug trafficking activities of 10th Street Gang members at the corner store by permitting drug transactions to occur inside and outside the store where he was an employee.

Additionally, Reuther held quantities of cocaine base inside the store for certain 10th Street Gang leaders, who are currently under indictment, until such time as the gang members were ready to sell quantities of crack to others. Also, individuals looking to purchase quantities of crack cocaine often made arrangements to purchase the drug from 10th Street Gang members through Reuther, who always had a contact number for gang members he could call to facilitate the drug deals.

The plea was the culmination of an investigation on the part of special agents of the Federal Bureau of Investigation under the direction of Special Agent in Charge James H. Robertson, the New York State Police under the direction of Major Christopher Cummings and the Buffalo Police Department under the direction of Commissioner Daniel Derenda.

Sentencing is scheduled for March 21, 2011 at 1 p.m. EST, in Buffalo, N.Y., in front of Judge Arcara.
