Brockton Man Sentenced to 63 Months in Federal Prison on Weapons Charges

BOSTON, MA—A Brockton man was sentenced in federal court today to a term of 63 months' imprisonment as a result of a conviction after a jury trial for being a felon in possession of a firearm and ammunition.

NADIR CABRAL, 24, was sentenced today to serve 63 months in federal prison by U.S. District Judge Patti B. Saris after a jury convicted CABRAL of being a felon in possession of a firearm and ammunition on July 1, 2010.

Evidence presented during the four-day jury trial last summer proved that on the evening of August 18, 2009, members of the Massachusetts State Police were driving an unmarked cruiser on Exchange Street in Brockton when they encountered a group of individuals, including CABRAL. The troopers observed CABRAL engage in suspicious actions consistent with attempting to discard a pistol. The troopers subsequently recovered a loaded .25 caliber semi-automatic pistol laying under a parked car that CABRAL had approached.

At today’s sentencing hearing, CABRAL faced a prison term of up to 10 years to be followed by up to three years of supervised release and a fine of up to $250,000. After noting that the possession of a loaded firearm in a heavily populated area such as Exchange Street in Brockton is a serious offense, Judge Saris sentenced CABRAL to serve 63 months in prison followed by three years of supervised release.

United States Attorney Carmen M. Ortiz; Richard DesLauriers, Special Agent in Charge of the Federal Bureau of Investigation, Boston Field Division; Guy Thomas, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives - Boston Field Division; Colonel Marian J. McGovern, Superintendent of the Massachusetts State Police; and Brockton Police Chief William K. Conlon made the announcement today. The case is being prosecuted by Assistant U.S. Attorneys Lisa M. Asiaf and Michael J. Crowley of the U.S. Attorney’s Major Crimes Unit.
