Newcomb Man Sentenced to Prison for Federal Assault Conviction

ALBUQUERQUE—This morning in federal court, Delsanto Ray Allen, 24, an enrolled member of the Navajo Nation who resides in Newcomb, New Mexico, was sentenced to 30 months in prison for his assault conviction.
Allen will serve two years of supervised release after he completes his prison sentence. Allen also was ordered to pay $600 in restitution to cover the victim’s medical costs.
Allen was indicted on January 26, 2012, and was charged with assault with a dangerous weapon and assault resulting in serious bodily injury.
According to the indictment, Allen assaulted a woman and caused her to fall from a moving vehicle on November 1, 2011, in Indian Country within San Juan County, New Mexico.
On May 3, 2012, Allen pleaded guilty to count two of the indictment, charging him with assault resulting in serious bodily injury.
As required by Allen’s plea agreement, count one of the indictment was dismissed after Allen was sentenced.
The case was investigated by the Farmington Resident Agency of the FBI and the Shiprock Division of the Navajo Nation Department of Public Safety and was prosecuted by Assistant U.S. Attorney Kyle T. Nayback.
